Samuel Etherton and wife to Anderson Etherton & others

Quit Claim Deed

This indenture made this eighteenth day of February in the year of our Lord one thousand eight hundred and forty two between Samuel Etherton of Jackson County and the State of Illinois and Charlooty his wifeof the first part and Anderson Etherton, Alexander Etherton, Alvin H. Etherton, Micajah H. Etherton of the same place of the second part (witneseth) that the said party of the first part for and in consideration of the sum of ten dollars to them in hand well and truly paid by the said party of the second part the receipt whereof hereby copied and acknowledged have given granted bargained xxx[ unknown word] & released and quit claim and by these present do give grant bargain sell alone release and forever quit claim unto the said party of the second part his heirs and asigns forever all the right title interest claim or demand which the said party of the first part have in and unto the following describe tract or parcel of land with the apportainments to lying and being situated in the County of Jackson and the State of Illinois and described as follows to wit. The North East fourth of the South East fourth of section twentyone township ten South of range two West of the third principle Meridian [note: this is forty acres] and lying in the Kaskaskia land district which was granted by a patten from the United States to Micajah Etherton and by deed from him to said Samuel Etherton and the said Samuel Etherton and wife by deed convey the same to the said Anderson Etherton, Alexander Etherton, Alvin H. Etherton, Micajah H. Etherton to have and to hold the above granted bargained & quit claim tract of land with all & singular the privileges and appertaines as therewith to belonging or in any wiseappertaining with said party of the second part his heirs and asignes forever and the said part of the first part for themselves their heirs executors & administrators hereby covenant and agree to & with said party of the second part his heirs & asigns that they will forever warrent & defend the same and that the above described tract of land is free & clear of all & every incumbrance whatsoever & that that they have full power & lawful authority to sell & convey the same in manner and form above written. In testimony whereof the said Samuel Etherton & Charlooty his wife have hereunto set there hands & seals the day and year above written.

State Of Illinois, Jackson County - Be it remembered that this day personally appeared before me the undersigned Justice of the Peace Samuel Etherton & Charlooty his wife to me nown as the grantors in the foregoing deed of conveyance & acknowledges that they voluntarily executed the same for the use & purpose therein xxxx [unknown word] the said Charlooty wife to the said Samuel being by me first examined seperate & apart from her said husband acknowledged that she executed the same freely & of her own accord without any compulsion of her said husband. In testimony whereof I have hereunto set my hand & seal the Eighteenth day of February one thousand eight hundred and forty two.
